First Party Legal ActionFor cases where the insurance company is the actual named defendant, the insurance company may have denied benefits, engaged in unfair practices that delay or hinder payment of benefits, or not offered to pay the full amount due under the insurance policy to its own customer. These insurance disputes are called "first party" legal actions; the insurance company is an actual party in the case. Some of these cases are breach of contract actions, where there is a dispute about whether the contract exists, or whether it provides coverage, or about the proper amount of benefits that should be paid under the insurance policy. Some of these disputes involve wrongful conduct by the insurance company, where the insurer has engaged in unfair or improper tactics in handling the claim. Cases against insurance companies that engage in such wrongful conduct are sometimes called "bad faith" cases.
